Terms and Conditions

By engaging to rent Palette (hereinafter referred to as the “Company”) photography studio you, the undersigned (herein referred to as the “Renter”), hereby state that you have read, fully understand and agree to be bound by the following terms and conditions.

Payment

Renter will provide full payment for all reservations of studio space in USD at time of booking. Renter’s date will not be held until this payment is received and cleared. If Renter does not show within 20 minutes of any reservation without notification, it is considered a no-­show. No-­shows are not refunded, transferred nor rescheduled and your reservation is forfeited. Company reserves the right to refuse reservations at its sole discretion.

Cancellations

Renter may cancel their booking until 30 days before the event start time and will receive a full refund (including all fees) of their booking price.
Renter may cancel their booking between 30 days and 7 days before the event start time and receive a 50 percent refund (excluding fees) of their booking price.
Cancellations submitted less than 7 days before the event start time are not refundable.

Change of Booking/Postponement

Changes of reservation date may be made until 1 week before for a change fee of $100. Unless otherwise agreed in writing, Renter will be charged a 100 percent fee if postponement of the assignment occurs the date of the rental and 50 percent fee if postponement occurs 1 week before the date of the rental.

Length of Use

Four hours minimum rental. Overtime will be calculated in increments of 15 minutes beyond the contracted end-time of the rental period when the Renter is either still using or cleaning up the studio space. Bookings that extend 15 minutes past the scheduled booking end time will be charged $60 per hour ($15/15min). Do not arrive late. Renter’s rental time begins promptly at the designated starting time and ends promptly at the designated ending time. If you need additional time and the studio is available you can purchase additional time at an hourly rate of $75/hr before your end time.

Terms of Use

Use of our studio and our equipment is AT RENTER’S OWN RISK. Renter hereby waives rights to seek legal redress for mishaps, accidents and/or loss while on the Company's premises. Renter agrees to leave the studio and adjacent grounds in the same condition as they were when Renter arrived. Renter is solely responsible for any legal infractions Renter or members of Renter’s party make during the conduct of the shoot, be they in the Company’s studio or elsewhere on the grounds. This includes all other violations or citations, and legal action resulting from the conduct of the shoot, taken at whatever time. Renter agrees to hold harmless the Company (its owner, agents, representatives and contractors acting on its behalf) for any loss, accident or injury to Renter’s self or anyone who accompanies Renter while on the Company’s premises. Renter agrees to be solely responsible for the conduct and welfare of all persons accompanying Renter while on the Company’s premises. Renters are solely responsible for the safety and well-being of any party Renter engages. Renter understands that if the Company observes dangerous, pornographic or negligent practices or activities the Company reserves the right to stop the shoot and require Renter and Renter’s party to leave immediately — HOWEVER, Company assumes NO RESPONSIBILITY to act in such cases. Renter agrees to hold the Company (its agents, representatives and anyone acting on behalf of Company) completely harmless from any action, legal or otherwise, that results from Renter’s conduct. Renters are solely responsible for verifying that all models employed during Renter’s rental period are of legal age for the activities they are to be engaged in. Company has no responsibility to determine or verify the age of participants in the Renter’s activities but reserves the right to end those activities if it becomes aware that legal age violations are on-going. Renter agrees that a Company representative can be present in the studio at all times Renters are using it.

Studio Equipment + Props

Company agrees to provide equipment in good working order, but makes no special guarantees as to said equipment’s functionality or suitability for Renter’s purposes. Company is not liable for acts out of its control that affect the shoot, such as power outages, weather or emergencies. In such cases, the Company will refund a prorated portion of Renter’s payment.

Studio lighting, props and accessories (if rented) must be returned to proper bags/place in the equipment room after use (cords wrapped and put away). All lighting, props and equipment will be inspected immediately after rental. Renter is responsible for any damages to equipment and props while using and must immediately report any damages to the Company if they occur.

Seamless paper backdrops may be used for an additional cost of $15/small roll sweep and $25/large roll sweep. If more than 20 feet is used, Renter may be charged additional fees. Please try to keep paper clean and free of wrinkles/dents. If paper is unusable after a rental session, please dispose of it properly. The Company does not guarantee the length or colors of seamless paper inventory in the studio unless specifically requested.

Miscellany

This Agreement incorporates the entire understanding and agreement between the Renter and the Company. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. The laws of the State of California shall govern this Agreement. Both parties have read this entire Agreement, agree to all its terms and acknowledge receipt of a complete copy of the Agreement signed by both parties. The person signing below shall be fully responsible for ensuring that full payment is made pursuant to the terms of this Agreement.

Cleaning

Clean up after yourself! Studio cleanup must be completed by the end of the rental period.

Be respectful of others and leave the studio as it was when you arrived (sweeping the floor, taking garbage out. There is a dumpster at the end of the driveway).

If the studio is not satisfactorily returned to the state it was prior to the rental period, a clean-up fee will be assessed in the range of $150-250.00.

Damage

Renter shall be solely responsible for any damage or theft to the Company’s property or equipment that occurs during the time Renter or their party occupies the Studio. Renter agrees to pay reasonable additional repair costs to bring damaged equipment back to working condition. Renter agrees to pay for damage to the Premises, including spills, excessive wear, marks or stains on furniture, fixtures or painted surfaces.

Any item within the Company’s inventory found missing after the rental period will result in 110 percent replacement cost being assessed to the Renter.

Prohibited Items and Activities

No Alcohol, Drugs or Smoking: You cannot engage in any activity on the Company’s premises while under the influence.

Music is to be kept at reasonable levels.

No Weapons: No weapons are permitted on the Company’s premises without written consent from the Company.

No Pornography: No photography, videography and/or audio of explicit sexual acts are permitted.

Misconduct: Including causing a nuisance to other clients, mistreatment of the Company’s staff, illegal activity, destruction/vandalism of the Company’s equipment or facilities.

Smoking is not allowed inside the studio. You may smoke outside, away from the studio entrance.

If evidence of smoking, to include scent, exists inside the space, a $300 cleaning fee will be assessed to the Renter.

Children

All children must be supervised at all times.

Pets

Dogs are allowed at the studio. There are other dogs in the neighboring spaces. Please keep dogs on-leash outside and supervised at all times.

Flame, Fire or Pyrotechnics

Open flame, fire and pyrotechnics are prohibited at all times inside the facility and within the grounds of the Company.

Renter Responsibility

The Renter is responsible for all activities of Renter’s Party brought into the studio or premises and any infraction to this agreement to include any fee assessment.

Rental Period

The minimum rental period is 1 week. The Renter understands and agrees that rentals for less than the minimum rental period will be charged at the full rental rate for the minimum rental period. (Ex: 1 day rentals are still charged the weekly price). Time extensions may be made to prop rentals but are subject to availability.

Payment

100 percent payment is due at time of booking rental reservation. All rentals are paid for and booked through the Company’s website.

Cancellation + Refunds

Cancellation of a reservation within 7 days prior to the pick-up date will not be refunded. No-shows for pick-up will not be refunded and forfeit the reservation of reserved props. Refunds will be made to cancellations made more than 7 days in advance of rental pickup date.

Late Pickup / Late Returns

Failure to return the order by 7pm on the return date will result in additional rental fees. 20 percent late fee per day per item.

Lost or Damaged Items

The renter agrees to return all rental items in the condition in which they were received, except for normal wear and tear and any necessary repairs as set out in paragraph seven. Renter is responsible to pay in full for lost or damaged items and fees will be assessed by the Company based on retail and replacement value.

Acceptance on As Is Basis

The Renter agrees to accept the rental items on an “as is” basis with the understanding that many of the items are used and may have imperfections, but that these imperfections will not affect the production value of the items.

Repairs

The Renter may, with the Company’s prior written permission, make necessary repairs to the rental items during the rental period.
